Description

I am Me Gabriel Fosse, a Montreal lawyer practising criminal and penal law. I hold a Master of Laws (LL.M.) in criminal law, and I represent clients in English and French from Place d’Armes in Old Montreal.

Impaired driving defence in Montreal

I defend impaired driving, over 80 and refusal charges, as well as dangerous driving and failing to stop at the scene of an accident (hit and run). Impaired driving charges in Quebec are prosecuted by the Director of Criminal and Penal Prosecutions (DPCP) in the Court of Québec or, in Montreal and several other cities, in the municipal court. My approach is analytical: I examine the disclosure line by line, test whether police had the grounds they needed, and raise Charter arguments where evidence was obtained improperly.

I also explain what a conviction would mean for your licence, your work and your ability to travel, so you can weigh every option before you decide how to proceed.

My practice areas

  • DUI and Impaired Driving
  • Dangerous Driving and Hit and Run
  • Drug Offences
  • Domestic Violence and Assault
  • Theft, Fraud and Economic Crimes

Where I help

My office is at 500 Place d’Armes, steps from the Montreal courthouse, and I serve clients across Greater Montreal.

Charged with impaired driving in Montreal? Key facts

From Quebec DUI Lawyers: in Quebec, a breath reading over .08 or a refusal to provide a sample brings an immediate 90-day licence suspension, and in some cases a 30-day vehicle seizure. Drivers 21 and under, learners and probationary licence holders must have no alcohol at all. A Criminal Code conviction leads to a licence revocation of one year for a first offence, three years for a second and five years for a third, and getting your licence back means passing an SAAQ evaluation and usually driving with an alcohol ignition interlock. See Quebec DUI penalties, our guide to Quebec impaired driving laws and what to expect from impaired driving charges. Speak with a lawyer early.

What to do now: keep every document police and the SAAQ gave you, including your suspension notice and your promise to appear, write down what you remember about the stop and the breath test while it is fresh, note any witnesses, and do not discuss the facts of your case with anyone before you have spoken with a lawyer. Bring all of it to your first consultation.
