Description

We are Abramovici Légal, a Montreal firm led by Me Jonathan Abramovici, who has practised since 2010. Our practice is focused on DUI and impaired driving defence, and we serve clients in English and French.

Impaired driving and licence suspension appeals

We handle cases under both the Criminal Code and Quebec’s Highway Safety Code. That matters in an impaired driving file, because the criminal charge and the SAAQ licence consequences run on separate tracks. We defend impaired driving, over 80 and refusal charges, and we act on licence suspension appeals when the SAAQ has taken your right to drive.

Impaired driving charges in Quebec are prosecuted by the Director of Criminal and Penal Prosecutions (DPCP) in the Court of Québec or, in Montreal and several other cities, in the municipal court. We also defend traffic tickets and demerit point matters, which can push an already suspended licence further out of reach.

Our practice areas

  • DUI and Impaired Driving Defence
  • Licence Suspension Appeals
  • Traffic Violations and Demerit Points
  • Criminal Code Offences (theft, assault, drugs)

Where we help

Our office is on Rue Saint-Antoine Est in Old Montreal, close to the courthouse, and we serve clients across the Montreal region.

Charged with impaired driving in Montreal? Key facts

From Quebec DUI Lawyers: in Quebec, a breath reading over .08 or a refusal to provide a sample brings an immediate 90-day licence suspension, and in some cases a 30-day vehicle seizure. Drivers 21 and under, learners and probationary licence holders must have no alcohol at all. A Criminal Code conviction leads to a licence revocation of one year for a first offence, three years for a second and five years for a third, and getting your licence back means passing an SAAQ evaluation and usually driving with an alcohol ignition interlock. See Quebec DUI penalties, our guide to Quebec impaired driving laws and what to expect from impaired driving charges. Speak with a lawyer early.

What to do now: keep every document police and the SAAQ gave you, including your suspension notice and your promise to appear, write down what you remember about the stop and the breath test while it is fresh, note any witnesses, and do not discuss the facts of your case with anyone before you have spoken with a lawyer. Bring all of it to your first consultation.
