Impaired driving defence in Montreal

DUI defence is one of our main practice areas. We defend impaired driving, over 80 and refusal charges in English and French. Impaired driving charges in Quebec are prosecuted by the Director of Criminal and Penal Prosecutions (DPCP) in the Court of Québec or, in Montreal and several other cities, in the municipal court. Long trial experience means we know how these files are built, where police procedure often falls short, and when a case should go to trial rather than be resolved.

We explain the immediate SAAQ suspension and the longer-term licence and travel consequences, so you understand what is at stake before any decision is made.

Our practice areas

  • DUI and Impaired Driving Defence
  • Drug Possession, Trafficking and Production
  • Sexual Assault and Domestic Violence
  • Fraud and Economic Crimes

Where we help

Our office is on the second floor at 480 Boulevard Saint-Laurent in Old Montreal, and we represent clients throughout the Montreal area.

Charged with impaired driving in Montreal? Key facts

From Quebec DUI Lawyers: in Quebec, a breath reading over .08 or a refusal to provide a sample brings an immediate 90-day licence suspension, and in some cases a 30-day vehicle seizure. Drivers 21 and under, learners and probationary licence holders must have no alcohol at all. A Criminal Code conviction leads to a licence revocation of one year for a first offence, three years for a second and five years for a third, and getting your licence back means passing an SAAQ evaluation and usually driving with an alcohol ignition interlock. See Quebec DUI penalties, our guide to Quebec impaired driving laws and what to expect from impaired driving charges. Speak with a lawyer early.

What to do now: keep every document police and the SAAQ gave you, including your suspension notice and your promise to appear, write down what you remember about the stop and the breath test while it is fresh, note any witnesses, and do not discuss the facts of your case with anyone before you have spoken with a lawyer. Bring all of it to your first consultation.
