I am S. Zalman Haouzi, a criminal defence lawyer who has practised since 2011. I represent clients in English and French across Greater Montreal, including Laval and Longueuil.
DUI defence is one of my main areas. I defend impaired driving, over 80, breathalyzer refusal and dangerous driving charges. Impaired driving charges in Quebec are prosecuted by the Director of Criminal and Penal Prosecutions (DPCP) in the Court of Québec or, in Montreal and several other cities, in the municipal court. A refusal charge in particular carries penalties as heavy as a high breath reading, so it is worth having the demand, the warning and the circumstances of the refusal reviewed carefully.
I meet clients early, explain the immediate SAAQ consequences and the criminal process, and build a strategy around the evidence in your file.
My office is on Rue Notre-Dame Ouest in Old Montreal, and I appear for clients in Montreal, Laval, Longueuil and the surrounding area.
From Quebec DUI Lawyers: in Quebec, a breath reading over .08 or a refusal to provide a sample brings an immediate 90-day licence suspension, and in some cases a 30-day vehicle seizure. Drivers 21 and under, learners and probationary licence holders must have no alcohol at all. A Criminal Code conviction leads to a licence revocation of one year for a first offence, three years for a second and five years for a third, and getting your licence back means passing an SAAQ evaluation and usually driving with an alcohol ignition interlock. See Quebec DUI penalties, our guide to Quebec impaired driving laws and what to expect from impaired driving charges. Speak with a lawyer early.
What to do now: keep every document police and the SAAQ gave you, including your suspension notice and your promise to appear, write down what you remember about the stop and the breath test while it is fresh, note any witnesses, and do not discuss the facts of your case with anyone before you have spoken with a lawyer. Bring all of it to your first consultation.
