Description

I am Leonard Waxman, a Montreal criminal defence attorney with more than four decades of courtroom experience. I practise criminal and penal law in English and French, and I offer 24-hour emergency support for people who have just been arrested.

Impaired driving defence in Montreal

I defend impaired driving, over 80 and breath sample refusal charges, together with other summary and indictable offences. Impaired driving charges in Quebec are prosecuted by the Director of Criminal and Penal Prosecutions (DPCP) in the Court of Québec or, in Montreal and several other cities, in the municipal court. Years in court have taught me where these cases are won: the grounds for the stop, the timing of the breath demand, the handling of the approved instrument and the right to counsel.

Because a conviction can affect travel, I also help clients with U.S. entry waiver applications, which many people need after a criminal record. I represent clients at bail hearings and through every stage of the case.

My practice areas

  • Criminal Defence (summary and indictable offences)

Where I help

My office is on Rue Saint-Jacques in Old Montreal, and I represent clients across the Montreal area.

Charged with impaired driving in Montreal? Key facts

From Quebec DUI Lawyers: in Quebec, a breath reading over .08 or a refusal to provide a sample brings an immediate 90-day licence suspension, and in some cases a 30-day vehicle seizure. Drivers 21 and under, learners and probationary licence holders must have no alcohol at all. A Criminal Code conviction leads to a licence revocation of one year for a first offence, three years for a second and five years for a third, and getting your licence back means passing an SAAQ evaluation and usually driving with an alcohol ignition interlock. See Quebec DUI penalties, our guide to Quebec impaired driving laws and what to expect from impaired driving charges. Speak with a lawyer early.

What to do now: keep every document police and the SAAQ gave you, including your suspension notice and your promise to appear, write down what you remember about the stop and the breath test while it is fresh, note any witnesses, and do not discuss the facts of your case with anyone before you have spoken with a lawyer. Bring all of it to your first consultation.
