Description

I am Stéphane Cohen, a Montreal criminal defence lawyer. I have practised criminal and penal law since 2000, and I represent clients in English and French from my office on Rue Saint-Pierre in Old Montreal.

Impaired driving defence in Montreal

Driving offences are a core part of my practice. I defend impaired driving, over 80 and refusal charges, as well as dangerous driving and traffic matters. Impaired driving charges in Quebec are prosecuted by the Director of Criminal and Penal Prosecutions (DPCP) in the Court of Québec or, in Montreal and several other cities, in the municipal court. I review how the stop was made, whether the breath demand and testing followed the rules, and whether your right to a lawyer was respected, because those details can decide a case.

A drinking and driving arrest in Quebec also affects your licence before any trial, so I explain how the SAAQ suspension and the criminal case fit together from your first call.

My practice areas

  • DUI and Impaired Driving
  • Dangerous Driving and Traffic Offences
  • Drug Offences (possession and trafficking)
  • Domestic Violence and Assault
  • Theft, Fraud and Shoplifting

Where I help

My office is at 417 Rue Saint-Pierre in Old Montreal, close to the Montreal courthouse, and I serve clients across Montreal and the surrounding region.

Charged with impaired driving in Montreal? Key facts

From Quebec DUI Lawyers: in Quebec, a breath reading over .08 or a refusal to provide a sample brings an immediate 90-day licence suspension, and in some cases a 30-day vehicle seizure. Drivers 21 and under, learners and probationary licence holders must have no alcohol at all. A Criminal Code conviction leads to a licence revocation of one year for a first offence, three years for a second and five years for a third, and getting your licence back means passing an SAAQ evaluation and usually driving with an alcohol ignition interlock. See Quebec DUI penalties, our guide to Quebec impaired driving laws and what to expect from impaired driving charges. Speak with a lawyer early.

What to do now: keep every document police and the SAAQ gave you, including your suspension notice and your promise to appear, write down what you remember about the stop and the breath test while it is fresh, note any witnesses, and do not discuss the facts of your case with anyone before you have spoken with a lawyer. Bring all of it to your first consultation.
